MEMBER ASSUMPTION OF RISK AND RELEASE
I UNDERSTAND THE RISK OF INJURY FROM USING ANY OF Whole Body Fitness LLC, equipment, is significant, including potential for permanent paralysis and death. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown. I acknowledge that this is an UNSUPERVISED FITNESS CENTER and I assume all risks associated with using exercise equipment and exercising alone without the aid and presence of any Whole Body Fitness LLC, staff on the premises.
I HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS Whole Body Fitness LLC, ALL OWNERS, LESSORS OF THE PREMISES, AND THEIR RESPECTIVE OFFICERS, AGENTS EMPLOYEES WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, LOSS OR DAMAGE TO PERSON OR PROPERTY THAT MAY ARISE OUT OF OR IN CONNECTION WITH MY USE OF ANY EQUIPMENT OR THE FACLITIES OF Whole Body Fitness LLC, OR ANY INCIDENT THAT OCCURS WHILE USING SUCH FACILITIES OR OTHERWISE REALTED TO MY MEMBERSHIP.
I expressly agree that this release is intended to be as broad and inclusive as permitted by applicable law and if a portion of the release is held invalid, the balance shall remain in full force and effect. The release shall apply to my heirs, assigns, personal representatives and any other next of kin. I understand that Whole Body Fitness LLC, is relying on this release in agreeing to enter this Agreement.
I HAVE READ THE RELEASE OF LIABILITY AND ASSUMPTIONS OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS AND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
Please check each box to signal you understand these rules and realities of our facility for you and all those on your membership. Failure to comply with these rules can result in membership termination and access to this facility to be revoked.
The MEMBER agrees that he/she has read, checked and understands all of the conditions set forth in the above Safety and Orientation Agreement and that it becomes part of the Membership agreement. Member also agrees that if this is a multiple or family membership that all members included in the membership have been apprised of all the rules regulations by the primary MEMBER of the membership.
